1. These general sales conditions are agreed between Armando Sérgio Soares Unip. Lda with address www.bricol.pt, Tax Number 514467711, Address Rua Júlio Fernando A. Fernandes nº13 – 3200-377 Lousã, Portugal and Email Address geral@bricol.pt, owner of the website www.bricol.pt hereinafter referred to as Online Store and people who wish to make purchases through the Online Store, hereinafter referred to as “User”.
2. The parties agree that purchases made through the Online Store will be governed exclusively by this contract to the exclusion of any conditions previously available in the Online Store.
ARTICLE 1. OBJECT
1. The purpose of these general sales conditions is to provide and define all the information necessary for the User regarding the ordering, selling, payment and delivery modalities of purchases made in the Online Store.
2. These conditions regulate all the steps necessary to place the order and guarantee the follow-up of this order between the Contracting Parties.
ARTICLE 2. ORDERING AND BILLING
1. The User places their order by completing the purchase process presented in the Online Store, adding the product(s) or service(s) they wish to order to the shopping cart:

The online store will honor orders received online only up to the limit of available stocks. If the product is unavailable, the online store undertakes to inform the User as soon as possible.
The data contained in the invoice is the sole responsibility of the User. The invoice is issued immediately after payment, once issued it cannot be reissued with changes.
Order requests are valid for (two days), unless the order is registered under a promotional campaign that defines a different deadline, and it is not possible to guarantee prices, discounts, promotions and offers beyond this deadline. If payment is not received by our services within the aforementioned period, the order cannot be validated. Any amount received after this date will be refunded or used for a new order.
ARTICLE 3. PAYMENT

In the case of payment by credit card, the debit will be made to the User's card immediately after confirmation of dispatch of the goods. If some ordered products are out of stock, their value will be credited to the User's card after placing the order.

ARTICLE 4. PRICES
Prices must be understood in Euros, with fees and taxes not included, taking into account the VAT in force on the date of payment of the order.
If there is an increase in the price of any product, the User will be informed immediately, and may choose to receive their order (paying the difference) or cancel it.
Whenever an item has a price reduction, the type of sale (sales, promotions or liquidation), the type of products, the reduction percentage, the start date and duration period and its communication to the competent authorities are mentioned, if it's necessary.
ARTICLE 5. DELIVERY AND SHIPPING INFORMATION
1. It is carried out by the company CTT or another similar transport company.
2. Shipping costs will be added to the order in accordance with the current table, which will be calculated during the purchase process before completion by the User.
3. The Online Store ships to all regions of the world (Regions outside the Iberian Peninsula and Archipelagos upon prior consultation).
ARTICLE 6. COMPLAINTS

ARTICLE 7. RIGHT TO FREE RESOLUTION
The USER has the right to freely terminate this contract within 14 calendar days, without the need to indicate any reason, in accordance with Portuguese legislation.
The period for exercising the right of free resolution expires 14 days from the day following the day on which you acquire or a third party indicated by you, other than the carrier, acquires physical possession of the goods.

In the event of termination of this contract, the payment made will be refunded, with the exception of the costs of returning the item, which will be borne by the consumer. The refund will be made without undue delay and, in any case, no later than 14 days from the date on which the goods are received and are in perfect condition of presentation and conservation.
We make this refund using, whenever possible, the same payment method that you used in the initial transaction, without incurring any costs as a result of such refund.
ARTICLE 8. EXCEPTIONS TO THE RIGHT OF FREE RESOLUTION
Exceptions to the Right of Free Resolution, in accordance with article 17 of decree-law no. 24/2014, of February 14, are considered, unless otherwise agreed by the parties, in the following cases:
a) Provision of services, when:
i) The services have been fully provided after the consumer's prior express consent, in accordance with article 15; It is

b) Supply of goods or provision of services whose price depends on fluctuations in financial market rates that the supplier of goods or service provider cannot control and that may occur during the free resolution period;

d) Supply of goods that, by nature, cannot be resent or are susceptible to deteriorating or becoming quickly out of date;
e) Supply of sealed goods that cannot be returned, for reasons of health protection or hygiene when opened after delivery;
f) Supply of goods that, after delivery and by nature, are inseparably mixed with other items;
g) Supply of alcoholic beverages whose price was agreed upon when the purchase and sale contract was concluded, whose delivery can only be made after a period of 30 days, and whose real value depends on market fluctuations that cannot be controlled by the professional ;
h) Provision of sealed audio or video recordings or sealed computer programs, from which the consumer has removed the inviolability guarantee seal after delivery;
i) Provision of a newspaper, periodical or magazine, with the exception of subscription contracts for sending these publications;
j) Celebrated at public auction;
k) Provision of accommodation, for non-residential purposes, transportation of goods, car rental services, restaurants or services related to leisure activities if the contract provides for a specific date or period of execution;
l) Provision of digital content not provided in physical form if:
i) Its execution begins with the prior and express consent of the consumer; It is
ii) The consumer recognizes that their consent implies the loss of the right to free resolution;
m) Provision of repair or maintenance services to be carried out at the consumer's home, upon request.
In the case of contracts provided for in paragraph m) of the previous paragraph, the right of free termination applies in relation to services provided in addition to those specifically requested by the consumer or the supply of goods other than replacement parts essential to carry out maintenance or repair.
ARTICLE 9. EXCHANGES AND RETURNS POLICY
All products purchased from the Online Store may be returned and refunded, whenever the customer expresses their intention within a maximum period of 14 days from receipt, as long as the same items have not been used, are in the same condition in which were delivered, in the original packaging and with the original labels. Shipping must be carried out, whenever possible, in the same box in which it was delivered.

The customer must check when delivering the order that it is in good condition and has not been damaged during transport. ARTICLE 11. WARRANTY CONDITIONS
The normal warranty for items through your BRICOL.PT online store is three years for non-professional end consumers, in accordance with Decree-Law No. 67/2003. This guarantee is valid in all member countries of the European Union. All equipment and accessories have a warranty period defined by the manufacturer, which in legal terms is at least 3 (three) years, if the customer is a final consumer (natural person) and 6 (six) months in cases of professional clients (legal person).
It is worth noting that the products offered through BRICOL.PT are from top brands and of the best quality. They are not “B” (white brands) or exhibition products. We also emphasize that the items offered in the BRICOL.PT store are sealed by suppliers and manufacturers, unless expressly indicated, in which the customer will be informed that the product has been examined or that it has been preceded by a routine control. The equipment available in the Store is correctly certified by the competent national and international entities.
The customer enjoys a full guarantee (return of the product and resending of a new one) within 14 working days after receiving the order. After this period of up to 2 years.

You must indicate the date and place of collection of the item to be repaired, so our collection services will collect and deliver the item repaired under warranty, without any additional cost for transport and components necessary for its repair. BRICOL, owner of the BRICOL.PT store, reserves the right to charge costs related to transportation whenever it is found that the equipment is not covered by the Warranty Conditions related to current legislation and, or the Manufacturer/Distributor's Usage Rules, and even when there is a second collection or re-delivery due to the customer's absence at the address indicated by the customer, as well as impossibility of collection by the carrier due to the article not being properly packaged, free of fuels, lubricants or other liquids inherent to the use of the article.
If the faulty equipment is covered by the warranty, the customer may go with it, and respective proof of purchase and/or warranty, to a technical assistance center of the brand.
BRICOL declines any responsibility for damage or loss resulting from the transport of assistance equipment whether or not covered by the Warranty Conditions.
If the user chooses other forms of return, the respective shipping costs will be their sole responsibility.
The warranty for products sold at the BRICOL.PT store is provided and established exclusively by the Manufacturer/Distributor of the product, under the conditions of handling, correct use, conservation and within the periods specified in the warranty certificates that accompany them.
In the event of any manufacturing or functional defect in products purchased through BRICOL.PT, the manufacturer of the same will be solely responsible. BRICOL.PT, in its capacity as an online sales store, provides its customers with the necessary mediation services to establish contact with the manufacturing or distributing company, thus effectively providing the customer with a guarantee under its terms.
For the guarantee to be effective, it is necessary to present the invoice or receipt for the purchase issued by BRICOL, owner of the bricol.PT store, as well as all packaging and additional content (manuals and accessories in general).
In all cases, the item's serial number must correspond to the files owned by BRICOL. The warranty will not be valid when factors external to the normal use of the product occur, such as voltage rises and peaks, use of inappropriate accessories or those prohibited by manufacturers, falls, water, fire, incorrect or abusive operations by the customer or third parties people not authorized by the manufacturer, lack of adequate maintenance recommended by the manufacturer.
The guarantee will be valid from the same day of delivery and/or acceptance of the order.
Battery Product Warranty
Battery-powered products have a 3-year warranty (natural person) and 6 months for professional users (legal person).
This warranty covers all material failures, but does not include: batteries, chargers, defective parts due to normal use, such as supports, brushes, and other wear components resulting from normal use.
The provisions of this guarantee do not exclude the benefits of the legal guarantee provided for in the Civil Code due to hidden defect(s) in favor of the buyer.
Manufacturers may offer additional periods, known as commercial guarantees, the length and duration of which differ depending on the products and brands. Said guarantees will be the exclusive responsibility of the manufacturer who is obligated to them.
We emphasize that BRICOL will not be responsible for possible damages that may have been caused by misuse, excessive or incorrect handling, unprofessional installation or malfunction due to external factors such as a short circuit.
